Responsibility for aircraft technology becomes harder to discuss when broad labels conceal the actual control. State’s November 21, 2016 revisions to Categories VIII and XIX addressed aircraft, related articles and gas turbine engines. A specific example was excluding L-100 and LM-100J aircraft from paragraph (a)(14). This November 27 retrospective considers that classification choice, not a new Sunday announcement. [2016-27775]

The exclusion was limited to the named paragraph. State also clarified that aircraft controls apply whether the aircraft is manned, unmanned, remotely piloted or optionally piloted. An ethical discussion should therefore avoid treating the presence or absence of a pilot as a complete answer about responsibility. The legal descriptions are more specific than that simple contrast. Commerce’s accompanying rule clarified military-aircraft and engine entries and expanded lists controlled only for anti-terrorism reasons. Together, the documents describe a division of regulatory work. They do not show that a particular sale would be prudent, harmful or beneficial. Both rules belonged to the same coordinated reform, so their agreement is not independent evidence of improved security. [2016-27775][2016-27777]

The competing concerns are understandable: predictable rules for people designing and supplying equipment, and care over how sensitive technology is controlled. The texts identify boundaries within which those concerns can be discussed; they do not resolve every moral judgment. Both specified December 31 effectiveness. State also preserved the distinction between export-list changes and unchanged permanent-import controls, a reminder that simplifying one classification does not erase other institutional responsibilities.
