Care for farm animals involves more than choosing between an indoor building and an open field. USDA's organic livestock and poultry rule, published January 19, 2017, requires living conditions that accommodate poultry health and natural behavior, including outdoor access, shade, shelter and dust-bathing materials. Its ethical significance lies in those concrete needs, rather than in a claim that certification settles every question of animal welfare. [2017-00888]

The April 2016 proposal had sought an outdoor-access definition excluding solid-roofed structures. The final rule took a different approach: unenclosed roofed porches and lean-tos may count if birds can freely reach other outdoor space. At least half that space must be soil, with maximal vegetation appropriate to the season, climate, geography, species and production stage, maintained so it does not shelter pests. Shelter and outdoor movement therefore need not be opposites within this design. The final text permits temporary confinement in specified circumstances, including conditions jeopardizing animal health or safety, and requires confinement to be recorded. Producers must also provide indoor room for birds to move, stretch their wings and engage in natural behavior. Care during confinement remains part of the obligation. [2017-00888]

For farmers, these are practical responsibilities with a staged schedule, not a demand that every physical change occur on publication day. The rule announced general implementation for March 20, 2018, alongside separate egg outdoor-access and broiler indoor-space transitions. Proposal and final rule document a policy choice within one evidence chain; they do not demonstrate that animals' conditions had already improved. [2017-00888][2016-08023]
