An inaccessible function can remain consequential even when a procurement exception is justified. The Access Board’s January 18, 2017 rule makes that tension concrete: section 508 provisions for undue burden or fundamental alteration require documented determinations and alternative means of access meeting identified needs. A constraint on technical compliance does not erase the person’s need to use information. [2017-00395]

The best-meets route similarly addresses unavailable conforming products through a documented purchasing choice and alternative access. Separate exceptions cover conforming legacy components unaltered on or after January 18, 2018, national-security systems and incidental contractor equipment. An ethical reading should acknowledge these material boundaries without confusing an exception with a finding that excluded technology serves everyone equally well. [2017-00395]

The February 2015 proposal offers another useful distinction: it organized accessibility around functions rather than product categories and proposed outcome-based criteria where technical provisions left features uncovered. The final rule retains a functional structure. That focus helps frame an access question around use, not possession of equipment. The two documents describe one agency process, not demonstrated universal usability. [2017-00395][2015-03467]

The rule’s published schedule set March 20, 2017 effectiveness and January 18, 2018 section 508 compliance; procurement standards depend on FAR Council adoption. Separate section 255 telecommunications guidelines require FCC adoption and preserve the readily-achievable qualification without suspending existing duties. Respect for users calls for explaining which responsibility applies and what alternative access it requires, rather than offering a general promise that the announcement has removed every barrier.
