Calling a material low in beryllium is not the same as showing that workers' exposure is low. OSHA's January 9, 2017 final rule makes that distinction explicit. Its exclusion for materials containing less than 0.1 percent beryllium by weight also requires objective data demonstrating exposure below the action level under any foreseeable conditions. [2016-30409]

That condition gives prevention an evidentiary basis rather than a reassuring label. The action level is an eight-hour average of 0.1 micrograms per cubic meter of air. The final permissible limit is 0.2 over eight hours, with a separate 2.0 microgram fifteen-minute limit. Composition, an action threshold and permissible exposure are different measures; collapsing them would obscure the worker's actual situation. [2016-30409]

The August 2015 proposal began with a general-industry standard and considered alternatives reaching construction and maritime work. The final publication establishes separate standards for general industry, shipyards and construction, retaining scope exclusions for qualifying unprocessed articles and qualifying low-content materials. These stages of one agency proceeding show the boundaries of responsibility being defined, not a finding that occupational harm has ended. [2016-30409][2015-17596]

An ethical reading can value practical prevention while acknowledging the work required to implement it. The final rule addresses exposure assessment and controls as well as medical surveillance. Its schedule separates March 10, 2017 effectiveness from general compliance in March 2018 and later facilities and engineering-control deadlines. Protecting dignity here means explaining the evidence and the obligations, without promising a risk-free workplace or speaking for a religious tradition. [2016-30409]
