A reasonable estimate of this year's liability and a record of last year's liability do different work. TTB's January 4 temporary alcohol-tax rule requires both for the new annual return option. Viewed from the January 7 weekend, the ethical question is concrete: how can simpler administration remain accountable to the public revenue it collects? [2016-31417]
The annual deferred-payment option requires expected current-year covered alcohol excise liability of no more than $1,000 and actual preceding-year liability within the same ceiling. Neither a small previous bill nor an optimistic forecast alone satisfies that description. The rule changes when qualifying taxpayers report and pay, not whether their alcohol excise taxes exist. [2016-31417]
The companion proposal makes another kind of accountability visible. Distillers and brewers filing annual returns would report operations annually only if their unpaid alcohol-tax liability stayed at or below $50,000 throughout the year. That includes imposed taxes not yet due. TTB explains that operating information protects revenue, so a payment calendar cannot stand in for the whole picture of an operation. [2016-31415]
There is room to value reduced paperwork without portraying oversight as needless. The temporary rule, effective January 4, implements PATH amendments applying January 1 and grants bond relief only under stated eligibility and deferred-payment conditions, with nonindustrial limits for spirits and wine. The reporting companion remains proposed. These stages of one agency process support a discussion of proportional responsibility, not a moral judgment about individual producers or proof of benefits already delivered.
