Returning an overpayment and imposing a penalty are different forms of accountability. HRSA's 340B rule published January 5, 2017 preserves that distinction for covered outpatient drug purchases by eligible covered entities. Under the final text, a civil monetary penalty for a manufacturer is additional to repayment, not a substitute for returning money owed through an overcharge. [2016-31935]
The distinction also guards against treating every error as proof of bad intent. The penalty provision concerns manufacturers with pharmaceutical pricing agreements that knowingly and intentionally charge above the ceiling. It permits, rather than automatically imposes, a penalty. Each order by National Drug Code counts as an instance, irrespective of the number of units ordered. Precision about responsibility matters alongside concern for program resources. [2016-31935]
The June 2015 proposal supplied a concrete pricing safeguard: if the formula produced less than one cent per unit of measure, the ceiling would be one cent instead. It rejected replacing that amount with a previous-quarter or non-340B price. The final text retains the conditional penny exception. Those records describe one agency's rulemaking, not independent testimony about manufacturers' motives or patients' experiences. [2016-31935][2015-14648]
A stewardship perspective can ask whether eligible purchasers receive the terms the program promises without declaring any party virtuous or suspect. The rule concerns those purchasing terms, not a universal consumer price or demonstrated improvement in care. Its original March 6, 2017 effective date was separate from HRSA's planned April 1 enforcement start. The obligation described is specific; the broader human benefit remains something to establish with evidence beyond these texts. [2016-31935]
