A warning that the person doing the work cannot understand offers little practical help. EPA's January 4, 2017 restricted-use pesticide rule puts a concrete obligation on supervising certified applicators: before use, they must provide instructions specific to the product and site in a manner the noncertified applicator can understand. Responsibility includes communication, not merely possessing expertise. [2016-30332]

The instructions must address labeling requirements and how site characteristics and application conditions may alter risks. The final provisions mention water, endangered species and local population among relevant site features. Supervisors must also ensure immediate communication is available and be physically present when product labeling requires it. These mechanisms connect care for the applicator with attention to surrounding people and resources. [2016-30332]

The August 2015 proposal had sought stronger training and supervision with an age-18 minimum. The final rule retains that general floor but permits specified noncertified users aged at least 16 under direct supervision by an immediate-family private applicator. Fumigants, sodium cyanide, sodium fluoroacetate and aerial applications are excluded from that exception. The relationship does not remove the remaining safeguards. Proposal and final are one agency's policy development, not independent proof of protection achieved. [2016-30332][2015-19988]

A responsible reading also keeps the promise in time. EPA originally set March 6, 2017 effectiveness, with a separate transition for certification plans and implementation determined in approval. It did not announce immediate compliance everywhere. The ethical value here lies in assigning specific duties before restricted-use applications, without claiming that rules alone establish safe conditions at any particular workplace or speak for a religious community.
