Responsibility starts with saying exactly what a declaration means. The chemical import rule CBP published December 27, 2016 concerns statements under the Toxic Substances Control Act. Calling a shipment certified without explaining the assertion can invite misplaced reassurance. The final process asks an importer or authorized agent to attest to a legal condition; it does not provide an agency judgment of general chemical safety. [2016-31055]
The August proposal provides useful language for that ethical distinction. A positive certification asserts compliance with applicable TSCA rules and orders, while a negative one says the chemicals are not subject to TSCA. Negative does not mean dangerous, and positive does not mean harmless. The two labels sort regulatory statements, not the worth of a supplier or the wellbeing of a community. [2016-20546]
The final rule recognizes that clarity can also remove an unnecessary declaration: a clearly identified TSCA-excluded chemical does not need negative certification. Chemicals within articles require certification only where a TSCA rule or order calls for it. A responsible explanation must preserve those boundaries rather than imply that more paperwork always means greater protection for people or the environment. [2016-31055]
CBP kept entry-specific written filing while allowing an electronic option and ending paper blanket certification, with January 26, 2017 stated for effectiveness. Read together, proposal and final rule describe one rulemaking, not proof of its eventual results. Stewardship here is a modest, concrete obligation: communicate the declaration accurately, including what it cannot establish about the risks borne by others. [2016-31055][2016-20546]
