Work does not become less real because a supplier sits farther from the government’s main contractor. SBA’s December 23, 2016 rule gives that observation a limited administrative expression: other-than-small primes with individual subcontracting plans can count qualifying lower-tier small-business awards toward their goals. The ethical question is how to recognize a contribution without exaggerating it. [2016-30874]

The agency’s October 6, 2015 proposal made the competing obligation explicit. The same subcontracting dollars were not to be counted twice or three times, even when an award appeared under multiple plans. From a stewardship perspective, acknowledging a smaller supplier and protecting the integrity of public accounting belong together. An inflated total would describe the paperwork more generously than the underlying award. [2015-25234]

The final mechanism keeps first-tier and lower-tier goals distinct. Each covered contractor reports its first-tier performance, and the prime remains responsible for accurate government reporting. Lower-tier contractors retain their applicable plan duties. That allocation gives the principle a practical form: recognition can extend through a chain while responsibility remains attached to the organizations supplying and using the records. [2016-30874]

There are boundaries to the promise. Commercial and comprehensive plans are excluded, as the proposal explained and the final rule confirmed. Effectiveness is set for January 23, 2017. Goal credit neither finances a business nor guarantees it a contract. These are two stages of one SBA rulemaking, not independent evidence that suppliers’ circumstances improved. Fairness here is a way to assess the design, not a claim that the design has already delivered fair outcomes. [2015-25234][2016-30874]
