A request for permission does little for personal agency if the person cannot understand what is being requested. That concern appears in the FCC's April 20, 2016 broadband privacy proposal: transparency about collection and use was a prerequisite for customer choice. The December 2 final publication turns that concern into a more specific framework for telecommunications information. [2016-28006][2016-08458]

The adopted structure treats health information, precise location and browsing histories as sensitive. It generally requires opt-in permission for sensitive uses and sharing, while nonsensitive information follows an opt-out approach. Statutory exceptions, including providing service, remain. Respect for a customer's choice therefore does not mean describing every movement of data as requiring a separate affirmative decision. [2016-28006][2016-08458]

For broadband providers, the final framework prohibits conditioning service on surrender of privacy rights. Financial incentives for information use instead face heightened notice and affirmative consent. The ethical distinction is between making access conditional on a waiver and presenting a disclosed choice about an incentive. The rule does not settle whether every such offer will feel equally affordable or understandable to every household. [2016-28006][2016-08458]

These documents record one agency's design process, not independent testimony about customer experiences. Implementation is prospective and staged, including separate security timing and paperwork-related conditions for specified provisions. An ethical assessment can ask whether notices communicate honestly and choices remain meaningful without claiming those outcomes already occurred. Protecting information also requires security: obtaining permission is not a substitute for taking reasonable care of what a provider holds. [2016-28006][2016-08458]
