Environmental stewardship depends partly on describing harm honestly. EPA's November 30, 2016 oil-and-gas rule addressed the accounting side: methods for detecting equipment leaks, factors for calculating their emissions and the associated reporting data. It did not establish that the leaks had been repaired. That distinction matters when technical compliance is presented as an assurance to people affected by an operation. [2016-27981]
The final rule allowed Method 21 with a leak definition of 500 parts per million by volume as an alternative to the specified optical gas imaging method. Separate leaker factors accompanied that option. Explaining the number accurately is itself a responsibility: 500 ppmv was a method-specific definition, not a general boundary between harmless and harmful exposure. [2016-27981]
In January, EPA had proposed aligning these reporting methods with then-proposed new-source performance standards and adding the factors needed to calculate emissions. The November final referenced finalized standards. Read together, the records show the development of an accounting framework. They are not independent witnesses to cleaner air, and the earlier proposal was not itself an operative command to facilities. [2016-01669][2016-27981]
Subpart W remained a reporting program without its own leak-repair mandate; other legal obligations could still require repair. The rule specified January 1, 2017 effectiveness and made confidentiality determinations for nine new or substantially revised data elements. The ethical question is what an operator does with the knowledge a report records. These documents define reporting choices, but cannot answer that question for any individual facility or community.
