The human stake in a fall-protection rule is the worker who must rely on the chosen equipment and the instruction behind it. OSHA’s final general-industry rule, published November 18, 2016, revises walking-working surface requirements and adds or updates provisions for personal fall protection and training. Its preventive purpose should not be confused with evidence that injuries have already fallen. [2016-24557]

The May 2010 proposal framed flexibility as a way to choose protection appropriate to the operation. It contrasted the earlier emphasis on guardrails and physical barriers with recognition of personal fall-protection systems. Ethically, our reading is that this is a choice among ways of meeting a responsibility, not a choice about whether the responsibility to protect a worker exists. [2016-24557][2010-10418]

The final timetable reflects material constraints as well as urgency. The general effective date is January 17, 2017, with initial training compliance due May 17, 2017 and specified rope-descent anchorage requirements due November 20, 2017. A phased rule therefore cannot honestly be described as a completed safety improvement on its publication date. Nor does a later deadline itself demonstrate that workers are adequately protected meanwhile. [2016-24557]

This November 19 account is retrospective context for a Friday publication. Both retained documents come from the same OSHA proceeding, so they explain the agency’s intentions and adopted framework rather than independently verify its consequences. Respect for workers includes being precise about that evidentiary limit: prevention is the objective, implementation is the task, and achieved benefits require evidence beyond announcing the rule.
