A finding about money-laundering risk in a jurisdiction is not a finding of wrongdoing against each person associated with it. FinCEN's final North Korea rule, published November 9, 2016, operates through specified financial institutions and correspondent accounts. Accurate description of those boundaries is part of treating people fairly, not a reason to minimize the agency's stated concern. [2016-27049]

The final definitions distinguish a North Korean banking institution from the broader financial-institution category used for indirect transactions. The latter includes covered branches, offices or subsidiaries of institutions chartered or licensed by North Korea wherever located, and branches or offices within North Korea of foreign financial institutions. The rule therefore follows institutional relationships, rather than applying a simple citizenship test to individuals. [2016-27049]

Its June proposal described safeguards intended to prevent access to U.S. financial channels, while anticipating notices and screening built on existing compliance practices. The final rule sets December 9 as its effective date and prescribes reasonable steps and risk-based diligence. These documents share a government rulemaking chain; they establish the rationale and adopted framework, not independent proof that every intervention would be justified. [2016-27049][2016-13037]

The ethical distinction is between preventing the specified institutional access and describing an entire population as suspect. Covered institutions must investigate and prevent identified misuse, with termination where necessary; the final text does not make account closure the sole response to every concern. This retrospective cannot judge particular transactions or the fairness of later implementation. It can preserve the rule's scope without turning a banking measure into a claim about people's worth.
