A traveler should be able to distinguish a search result from an undisclosed preference for a particular airline. The Transportation Department’s November 3, 2016 final rule addresses that distinction in electronic displays combining multiple carriers. It requires disclosure when carrier identity drives a system-imposed preference within the rule’s scope. The requirement does not mean that every display must contain every airline or that all commercial preferences disappear. [2016-26178]

The May 2014 proposal placed this concern alongside another barrier to informed choice: incomplete information about ancillary fees could make the true cost of travel difficult to understand. That history shows why disclosure matters without turning a broad aspiration into a completed reform. The November final rule reserved basic ancillary-fee disclosure for additional rulemaking and left other ticket-agent subjects for later action. [2016-26178][2014-11993]

Under the adopted display provisions, a notice must clearly and conspicuously identify carrier-based bias at the top of each search-results display. User-selected criteria receive separate protection: the options best meeting those criteria must be displayed conspicuously and no less prominently than other options. The text also distinguishes user choices and corporate contract travel arrangements from the carrier-identity factors triggering the specified bias disclosure. [2016-26178]

December 5, 2016 is the stated effective date, while new reporting obligations have a later schedule tied to 2018 operations. The ethical value of these provisions is intelligible choice, not a promise that every displayed recommendation is best for everyone. Both sources are documents in one government chain; neither demonstrates achieved savings or consumer understanding. Honest presentation requires naming what the rule does—and what its uncompleted proposals do not yet establish. [2016-26178][2014-11993]
