Seeking safety should not require a person to adopt a provider’s beliefs. The November 2, 2016 final regulations for Family Violence Prevention and Services Act programs prohibit service discrimination based on religion, religious belief or refusal to hold a belief or participate in religious practice. The provision places people with different convictions, including none, within the same service-access framework. [2016-26063]
The earlier October 2015 proposal supplies another dimension of personal agency: confidentiality was intended to keep perpetrators from identifying or locating victims. It proposed limits on disclosure rather than treating a service request as permission to circulate someone’s identity. In the final rule, providers cannot make consent to release identifying information a condition of eligibility. Access and control of personal information are connected protections. [2016-26063][2015-25726]
Those protections require careful description. The confidentiality rule allows specified exceptions, including legally compelled disclosure and certain reporting of abuse or imminent serious harm when mandated or expressly permitted by the state or tribe. Compelled release also brings duties to attempt notice and protect affected people’s safety and privacy. Respectful treatment is not served by promising secrecy broader than the actual rule provides. [2016-26063]
The regulations take effect January 3, 2017 and concern FVPSA-funded programs. Neither their publication nor their aim of wider access establishes that an individual can immediately obtain shelter. The proposal and final rule belong to one government policy process, not independent evidence of successful protection. The ethical task is to preserve choice while being honest about obligations and limits: a right to nondiscriminatory treatment cannot be reported as a confirmed placement. [2016-26063][2015-25726]
