Who makes the decision is central to the independent-living regulations HHS published October 27, 2016. Section 1329.4 defines consumer control in two settings: power within a center or eligible agency, and control over an individual's own choices. The distinction matters because respectful language from a provider is not the same thing as a formal role in decisions. [2016-25918]
At the organizational level, the definition places power and authority with individuals with disabilities, including current or former recipients of independent-living services, across management, staffing, operations and service provision. At the personal level, it describes control over life choices and an independent living plan, including informed choices about its content, goals and implementation. These are concrete elements of the regulatory definition, not a claim about every provider's actual practice. [2016-25918]
The administrative reform had a longer history. HHS's November 16, 2015 proposal explained the transfer of Independent Living Services and Centers for Independent Living from Education and the intended consolidation of regulations. The final rule implemented the amended Rehabilitation Act under the Administration for Community Living and set November 28, 2016 for effectiveness. The earlier proposal is background, not a substitute for the final definitions. [2016-25918][2015-28888]
Our ethical reading is that assistance and personal authority should be assessed separately: useful help does not itself establish that a person controls the decisions affecting them. The two documents belong to the same regulatory process. They describe a model of participation without proving its delivery, guaranteeing an individual benefit or showing that local constraints disappeared. That leaves a practical question for any service relationship: whose informed choices direct the plan? [2016-25918][2015-28888]
