A traveler facing a revoked visa needs to know what kind of revocation is involved. The State Department's October 20, 2016, EVUS rule made a specific distinction: failure to satisfy applicable information-update requirements would provisionally revoke a designated visa, while subsequent compliance would automatically reinstate it. That consequence was real, but describing it as an automatic permanent ban would misstate the mechanism. [2016-25321][2016-25308]
The companion Homeland Security rule defined the program's initial population as holders of unrestricted, maximum-validity B-1, B-2 or combined B-1/B-2 visas in People's Republic of China passports. Generally ten-year visas, the definition included those issued for more than nine years and replacements correcting errors. It did not describe every Chinese passport holder, every foreign visitor or every kind of visa. [2016-25321][2016-25308]
Homeland Security also distinguished unsuccessful enrollment from a message that State had revoked the visa. An unsuccessful enrollment did not itself permanently revoke the underlying visa, and another attempt was possible. A separate State revocation required a new visa and successful enrollment before travel. Even a valid EVUS compliance notification did not settle admissibility; border inspection remained a separate decision. Travel compliance was to begin November 29. [2016-25321][2016-25308]
Our ethical reading is that explaining a remedy matters as much as explaining a sanction. Travelers should not be told that a reversible information failure necessarily ends all future travel, or that submitting information guarantees entry. These two rules describe complementary parts of one administrative policy, not independent evidence of fair outcomes. This is an account of the 2016 design, not current immigration advice.
