For a household facing interrupted earnings, permission to file a request and the month benefits begin are materially different promises. The Social Security Administration’s October 17, 2016 final rule changes expedited-reinstatement filing eligibility, but it does not promise immediate or permanent restored benefits. Clear communication about that limit is part of treating applicants with respect. [2016-24873]
The May 11 proposal explains the old obstacle: someone who stopped substantial gainful activity during a month could already have earned too much to request reinstatement that month. SSA proposed accepting the request at first contact, allowing the file to move toward a medical determination. This was an administrative rationale for reducing delay, not evidence that every applicant would qualify. [2016-24873][2016-10932]
Under the final rule, section 404.1592e starts provisional benefits in the request month if no substantial gainful activity occurs that month, or in the following month if it does. Reinstatement eligibility still depends on the relevant conditions, including inability to perform such activity because of the same or a related impairment. Requesting help and securing a final determination remain separate steps. [2016-24873]
Most amendments take effect November 16, 2016; the reinstatement eligibility changes in sections 404.1592c and 416.999a take effect April 17, 2017. The package also removes extra conditions for unsuccessful work attempts lasting three to six months. Our ethical judgment is that explanations should make those distinctions visible, rather than offering reassurance the rule cannot support. Both documents come from the same SSA policy process, not independent assessments of household outcomes. [2016-24873][2016-10932]
